Functionland Decentralized Storage Solution Terms and Conditions

Introduction

Welcome to Functionland, a decentralized storage solution designed to provide secure, encrypted storage for your digital assets. Our services include the Blox hardware device, the FxBlox setup application, the Fula network, and the FxFotos application (collectively, “Services”). By using any of our Services, you agree to the following Terms and Conditions (“Terms”). Please read them carefully before using our Services.

Encryption and Data Use

1. Data Encryption: All data uploaded to the Fula network is encrypted. You acknowledge that you are responsible for maintaining the security of your encryption keys. Functionland cannot decrypt your data but needs to be able to transmit your data across the network for backups.
2. No Intention to Use Data: Functionland does not intend to access, use, or analyze your data for any purpose other than to provide the Services described herein and to provide statistics of network usage (such as the number of users, total usage and other usage statistics). Your data remains your property, and we are committed to ensuring its privacy and security.

User Responsibilities

1. Backup and Data Loss: You are responsible for maintaining appropriate backups of your data. While we strive to ensure the reliability and availability of our Services, Functionland is not liable for any data loss or corruption.
2. Compliance with Laws: You agree to use our Services in compliance with all applicable laws and regulations, including but not limited to data protection and privacy laws.

Disclaimers and Limitation of Liability

1. Service “As Is”: Our Services are provided “as is” and without warranties of any kind, either express or implied. Functionland expressly disclaims all warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.
2. Limitation of Liability: To the fullest extent permitted by law, Functionland shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

Indemnification

You agree to defend, indemnify, and hold harmless Functionland and its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from your use of the Services or violation of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by the laws of Ontario, Canada. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration under the rules of the Arbitration Association in Ontario, Canada.

Modifications to Terms

Functionland reserves the right to modify these Terms at any time. We will provide notice of any significant changes and your continued use of the Services following such changes will constitute your acceptance of the new Terms.
