1. Acceptance of Terms

By accessing and using fx.land (the "Website"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Website. The Website is owned and operated by Functionland Inc ("Functionland"), a corporation incorporated under the laws of Canada, on its own account and for its own products and services.

2. Nature of the Website

The Website is an informational, marketing and commerce resource operated by Functionland Inc for its own products and services. It provides general information about FxBlox storage hardware, the FxBlox and FxFiles apps, the on-chain loyalty platform, and Functionland's work as a grantee of Fula Governance Association. The Website does not constitute:

• An offer to sell or solicitation to buy any tokens, securities, or financial instruments
• Investment, financial, tax, or legal advice
• A guarantee or promise of any returns, rewards, or income
• A representation by Functionland regarding the operations, governance, or obligations of FGA

3. Role of Functionland Inc

Functionland Inc is an independent Canadian company. Its own products are FxBlox storage hardware, the FxBlox and FxFiles apps, and an on-chain loyalty platform. Separately, it is part of the Fula community and a grantee (receiver of grants) of FGA whose work adds value to the Fula network. Functionland Inc has received grants and backing from a number of organizations over the years; FGA is one of them. Functionland acts independently and on its own account. The work Functionland carries out under grants awarded by FGA is limited to:

• Development, marketing and maintenance of the Fula network software and blockchain, under grants awarded by FGA
• Operating and maintaining this Website for its own products and services
• Designing, marketing and selling the FxBlox hardware device and Functionland's own applications

Functionland does not:

• Sell, distribute, or manage FULA tokens or any cryptocurrency
• Manage or have access to any token treasury
• Issue, sell, or manage NFTs
• Provide custodial services for any digital assets
• Act as a financial intermediary, broker, or exchange
• Make investment decisions on behalf of FGA or any user

The relationship between Functionland and FGA is strictly that of a community member and grantee. Functionland is a separate and independent legal entity from FGA, acts independently, and has no authority to bind FGA or make representations on its behalf beyond the scope of the grants it receives. Participation in the Fula community and receipt of grants confer no governance or decision-making authority over FGA, and FGA has no authority to bind Functionland Inc. 4. Fula Governance Association

FGA is an association organized under the laws of Switzerland. FGA is solely responsible for all matters relating to:

• The FULA token, including issuance, distribution, and treasury management
• NFT issuance and management
• Network governance and protocol decisions
• Investor and partner relations
• Regulatory compliance relating to tokens and digital assets

Any mention of the FULA token, NFTs, or the Fula network on this Website is informational only and relates to matters governed by FGA. For information about the Fula network, the FULA token, NFTs, staking, governance or grants, visit fula.network. Users must conduct their own independent due diligence regarding FGA and any associated tokens, assets, or investments.

5. No Investment Advice

Nothing on this Website constitutes investment advice, financial advice, trading advice, or any other form of professional advice. You should not treat any of the Website's content as such. Functionland does not recommend that any cryptocurrency, token, or digital asset should be bought, sold, or held by you. You acknowledge and agree that:

• Blockchain technology, cryptocurrency, and decentralized networks involve substantial risks, including but not limited to the risk of total loss of value

• You are solely responsible for evaluating the risks associated with interacting with any blockchain, token, or decentralized application
• Functionland provides no warranty or guarantee regarding the performance, security, or availability of the Fula network or any associated products or services
• Hardware devices such as the FxBlox are sold "as is" and any performance claims are estimates, not guarantees

7. Limitation of Liability

To the maximum extent permitted by applicable law:

Functionland Inc shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

• Your use of or inability to use the Website
• Any action taken or decision made by you in reliance on information provided on the Website
• Loss of tokens, cryptocurrency, digital assets, or fiat currency
• Loss of data, profits, or business opportunities
• Any acts, omissions, operations, or obligations of FGA
• Any third-party products, services, platforms, or applications linked from the Website
• Network downtime, bugs, errors, or security breaches in the Fula network or any associated software
• Regulatory actions affecting the FULA token, FGA, or any related entities

Fula Governance Association is a separate legal entity from Functionland. Any claims, disputes, or liabilities relating to FGA's operations, token management, NFTs, or governance must be directed to FGA and are governed by Swiss law.

8. Disclaimers

The Website and all information, content, and materials available on it are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. Functionland disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

For matters relating to Functionland Inc and this Website: These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

For matters relating to Fula Governance Association: All matters relating to FGA, including but not limited to the FULA token, NFTs, network governance, staking, and investor relations, are governed by the laws of Switzerland. Any disputes relating to FGA shall be subject to the exclusive jurisdiction of the courts of Switzerland.

You acknowledge that Functionland Inc and FGA are separate legal entities with separate governing laws and jurisdictions, and that claims against one entity cannot be brought against the other.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Functionland regarding your use of the Website.
